Dying man awarded $396m after jury rules weed killer gave him cancer

The case of school groundskeeper Dewayne Johnson was the first lawsuit alleging glyphosate causes cancer to go to trial.

Correspondents say the California ruling is likely to lead to hundreds of other claims against Monsanto, which was recently bought by the German conglomerate Bayer AG.

"On the basis of scientific conclusions, the views of worldwide regulatory authorities and the decades-long practical experience with glyphosate use, Bayer is convinced that glyphosate is safe and does not cause cancer", the company said in a statement.

A California jury on Friday ordered the U.S. agrochemicals giant - which was taken over by Germany's Bayer in June - to pay almost $290 million in compensation to a groundskeeper diagnosed with cancer after he repeatedly used Monsanto's weed killer, Roundup.

Robert F. Kennedy Jr - an environmental lawyer, son of the late USA senator and a member of Johnson's legal team - hugged Johnson after the verdict. "Roundup could cause cancer", Johnson's lawyer Brent Wisner said in a statement, according to the news outlet.

The 46-year-old who was awarded the damages, said he developed a deadly form of non-Hodgkin's lymphoma after spending years spraying large amounts of Monsanto's Roundup and other glyphosate herbicide brands on school grounds.

"We are sympathetic to Mr. Johnson and his family", Partridge said.

Monsanto vice president Scott Partridge said hundreds of studies showed the herbicide does not cause cancer and said the company would appeal the verdict to "vigorously defend this product".

Glyphosate is the most common weedkiller in the world, and the safety of its use has been a topic of hot debate for some years. About 80 percent of his body is now covered in lesions, CNN reported, and his doctors said he is unlikely to live past 2020. Emails sent the duo seeking comment on the California court's verdict and government plan of action remained unanswered at the time of publishing this article. As per the Indian food regulator FSSAI, the maximum permissible residue levels of glyphosate as of December past year are: 1 mg/kg in tea, 0.01 mg/kg in rice and 0.05 mg/kg in meat.

However the International Agency for Research on Cancer, a division of the World Health Organization, said in a 2015 report that it was "probably carcinogenic to humans".

The company said it intends to appeal against the verdict.

"Did Monsanto fail to adequately warn of the danger?"

Several North Texans have also sued Monsanto claiming Roundup caused them to get sick.

But the US Environmental Protection Agency (EPA) continues to insist that glyphosate is safe when used carefully. In Europe, too, the battle over glyphosate has been fierce.

What became referred to as the "Monsanto Tribunal", in a purely advisory opinion, called for stronger laws protecting people and the environment from corporations, and a prosecutable crime of "ecocide".

Johnson was awarded a total of about $39 million in past and future losses, both economic and noneconomic, but it was the $250 million in punitive damages that seemed to take the courtroom's breath away, as a sigh was heard on a video recording when Bolanos made the announcement.
